HANKINSON, ND — A 23-year-old North Dakota man got a Christmas present of sorts on Christmas Eve: Instead of hard time, he’ll be doing community service as punishment for having sex in a public place.Joshua Fenske pleaded guilty to a misdemeanor charge of public fornication after he and a female companion were caught with their pants down inside the Spare Time Bar in Hankinson, ND. According to published reports, several intrepid bar patrons captured the half-hour tryst with their cell-phone video cameras, making life easy for the prosecution.

If Fenske successfully completes his sentence—which includes one year of probation and $850 in fines and court fees in addition to 32 hours of community service—he will not be listed on the state’s sex offender registry. Because his record includes prior alcohol-related offenses, he could have faced a maximum penalty of $2,000 in fines and one year in jail.

Fenske is forbidden from using alcohol while on probation and barred from the Spare Time Bar, which was ordered to close for a week as a result of the incident. According to Spare Time owner Roger Boutain, the bartender was fired.

Adriane Diede, 21, of Breckenridge Minnesota, also faces a charge of public fornication for her part in the October 12th incident. She is not scheduled to appear in court until after the first of the year.
