May the DMCA Force be with You
YNOT – Adult entertainment studio Pink Visual, among the most vigorous defenders of intellectual property rights in the industry, has launched a new service designed to allow other IP owners to enforce their own rights.
According to Pink Visual President Allison Vivas, DMCA Force — named for the Digital Millennium Copyright Act, a U.S. law upon which many companies base their IP enforcement programs — is meant to give rights-holders an easy, affordable way to conduct well-rounded, effective anti-piracy campaigns.
“Our goal is to understand the needs of each individual client, focus on their specific priorities and customize an approach that is right for them,” Vivas said.
DMCA Force’s standard services include DMCA take-down notifications, infringement and take-down monitoring and the creation of digital fingerprints for content owners.
“Since we’ve seen direct results from the creation and monitoring of our own [digital] fingerprints not only in preventing infringement but also with monetizing infringement, we wondered why more companies were not fingerprinting their content,” Vivas said. “Beyond common misconceptions concerning the cost of fingerprinting, we found many companies had technical barriers to the creation of fingerprints. To address that problem, we have designed a system to create and manage digital fingerprints on behalf of other companies that requires minimal coordination on their part.”
The combination of infringement monitoring and fingerprinting allows DMCA Force to ensure the technology is utilized correctly, Vivas said.
Advanced services offered by DMCA Force include trademark monitoring, copyright and trademark registration services, litigation target evaluation and litigation evidence packaging.
“Although we won’t be providing specific legal advice to our clients, we believe we can bridge the gap between business owners and attorneys and point our clients in the right direction for answers,” Vivas said. “As rights-holders ourselves, and as a company that has been involved in its fair share of copyright litigation, we understand copyright owners’ needs, and we are very familiar with the challenges they face whether they choose to litigate or pursue alternative anti-piracy strategies that do not include litigation.”
According to Vivas, one of the most important components DMCA Force offers is the perspective Pink Visual has gained over the past several years through the company’s own anti-piracy efforts.
“When we first got started with enforcing our copyrights it was a bit overwhelming, but as we developed and executed our anti-piracy strategy, we quickly transformed from feeling victimized to feeling empowered,” Vivas said. “We want other adult studios to have that same sense of empowerment, by making anti-piracy efforts easy and inexpensive, and centralizing [everything] in one location with one service.
“Of course, we also believe that the more content owners participate in anti-piracy strategies, the better it is for the overall market when overwhelmingly large amounts of content are no longer available so easily,” she added.
