Man Sues Pornhub Alleging Unauthorized Image Use
New Jersey — Edward Kelly of Marlton, NJ has sued Pornhub, seeking more than $3 million in damages and compensation for the use of his image, which was allegedly used in an ad and posted on the site without his approval.
In the image in question, Kelly appears to be sitting in a car wearing a cap that’s cocked to one side of his head. He’s also flashing a fan of $100 bills.
The image was used in an ad, which invites viewers to “make $752/day like me.”
“See how I get it,” the ad tantalizes.
According to a report on the lawsuit, Kelly was “dismayed and distraught” to learn from a friend that his photo was being used in an ad on Pornhub.
The suit says the picture was “taken and owned by” Kelly, who does not know “how his photo was extracted and/or disseminated.”
“Someone on Pornhub’s advertising team found the photo… and decided to use it in an ad campaign without [Kelly’s] consent,” it states.
The suit says Kelly works “in the secular computer field” and believes people seeing the ad “could reasonably believe that [he] intentionally consented to Pornhub’s use of his image.” The suit also says the ad featuring Kelly’s image has been on Pornhub for at least six years.
