Would you literally walk right up to them while they were busy doing a service for you and ask them to suck your dick or massage your breasts? I mean, while you may sometimes think about it, would you actually do it? NO? Then why would you possibly think you could do it with your models?
I get calls every week from somebody looking to become the next adult Internet version of Hugh Hefner. These certain newbies think by becoming a photographer, a content provider, or a paysite owner, this gives them license to grope their models. They are all fired up to get into Internet porn and make a million dollars, and sleep with a bunch of hot models. For example, I recently received a call from a gentleman who I spent a good hour on the phone with, about how he wanted to get involved as either a content provider or a paysite owner.
Why did he want to be a content provider or paysite owner? According to him, he is very good in bed. Huh??? Yeah, he wants to get involved so he can basically fuck his models, and hide it behind the pretense that he is shooting content. And if he sleeps with enough of them, and takes their pictures as he is doing this, then he can put up a paysite and make a million dollars.
WHOA! Back up a bit here. Read my Newbie Agreement. You are breaking way too many rules. There are so many aspects of this guy’s thought processes that are wrong, I just cannot address them all in one article. Seriously, I spent over an hour on the phone with this guy, and if he reads this, I hope maybe I can now get my messages into his head. I explained to him how he should probably start with a free site, then move up to a paysite. Or if he wanted to shoot his own content, and build a content company, then he should probably start with a business plan and reading up on the legalities of owning a company in our industry.
Every time I brought up a point, he generally shot it down with the fog I see some newbies getting lost in. No, you probably can’t just pick up the phone and call the largest affiliates on the ‘Net and ask them to buy your content, even if you are really good at sex… err… taking pictures. No, you probably won’t have real high quality content if you “just go out and buy a new camera… one of those digital types.” And NO, you probably should not start a company up just so you can get laid. Actually, you probably shouldn’t be in this industry because chances are you will end up either in jail, broke, or both.
Newbies… come on! Have you heard of the PROTECT Act? Do you know what 18 USC §2257 compliance is? If you aren’t familiar with what these are, you should find out today. How about the more mainstream terms of sexual harassment, or even rape? Nowadays, starting work in the adult Internet business just to get laid is like robbing the hotel bank during a SWAT Team convention. We not only have to abide by society’s laws, we also have our own special “adult Internet” laws. Don’t get me wrong, you can get involved and “enjoy” what you do, but you need to start by thinking with the “big head” first.
For example, I often have the pleasure of meeting my good friend Dave Cummings for a cup of coffee and some conversation. Dave is very much “in the know” and has his fingers on the pulse of the adult Industry. It also seems as though every time we get together, I learn something new on how to protect oneself even further from possible future prosecution when dealing with models and photo shoots. Dave has it covered like almost no one I know. His approach is business, first and foremost. He is complete with up-to-date model release forms, pre-shoot speeches he requires his models all say on video, and his full disclosure of what is expected of the models.
Dave adds, “My ‘requirements’ are focused upon having the model re-verify her age on video by her stating her age at the same time I have her holding her ID close to her face so that it’s visible to the camera. I then ask her when was the last time she consumed alcohol or any drugs, even over-the-counter ones if they were the kind that might have made her drowsy or could affect her judgment. My focus here is to demonstrate that she is in full control of her faculties and not even the least bit hesitant in making the decision to film the sex scene we are about to do.
I also ask her to describe what she’s being asked to do in today’s filming, and whether or not she is voluntarily doing it and with the full realization that it’ll be MY copyrighted material once shot.”
Needless to say, Dave certainly protects himself as well as all the models he works with. This is fantastic.
While I’m sure Dave gets to unload plenty of his personal sexual satisfaction doing these photo shoots, and working on content for his website, you can bet that Dave is an expert on the “do’s” and “don’ts.” He loves his work – he gets to have sex with hot women. But he works just as hard on the business side and the paperwork. He does plenty of research to keep educated, and he has surrounded himself with smart, ethical people, such as Jeff Miller and Richard Chapo. This is necessary to help ensure he is treating this as a business first.
You have to be prepared to be very anal today (forget the pun) to start up a new company in this industry. You have to double-check every contract, every model release form, and every scrap of your record taking. The PROTECT Act alone will guarantee somebody in our industry is going to jail for a minimum of five years. Take the time to find out about the legalities of everything. Don’t let yourself get so excited and fogged up about working with models until after you talk to your lawyer and he hopefully slaps you back into reality. This is a business, you are the employer, the models are your employees, and you need to treat them as such. If you are getting into this industry because you are thinking this is a cool new way to get laid, you are seriously mistaken.
Just because you put an ad in the paper, got a few call backs, and have a model coming over, do not think they are there to do what you want. Make sure you have all your paperwork ready, your procedures ready, and your explanation for the model on why she is coming over is clear and understood. The alternatives for this behavior are potentially devastating and shit could hit the fan. If shit hits the fan, you still probably don’t want to fuck that plumber, but you may start thinking about the screwing you’re going to get from a prosecuting attorney.
